1. Acceptance of Terms
By accessing and using the website located at https://www.novpax.org and the Paxai digital wellness application (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. These Terms constitute a binding legal agreement between you and Nov Pax ("Company," "we," "us," or "our").
If you do not agree to these Terms, you must not access or use our Services.
2. The "Beta" Nature of Services
You acknowledge that Paxai is currently in a "Beta" (v0.1) phase of development. By using the Services, you understand and agree that:
- Stability: The Services may contain bugs, errors, and other problems that could cause system failures.
- Data Integrity: We do not guarantee that data generated or stored during the Beta phase will be preserved. We reserve the right to wipe, reset, or modify user data at any time during updates.
- "As-Is" Usage: The Services are provided "AS IS" and "AS AVAILABLE" for the purpose of testing and providing feedback.
3. NOT Medical Advice

Paxai is a productivity and digital wellness tool. It is NOT a medical device or service.
The content, analytics, and suggestions provided by Paxai are for informational and self-improvement purposes only. They are not intended to be a substitute for professional medical advice, diagnosis, or treatment of any mental health condition (such as anxiety, depression, or burnout). Always seek the advice of your physician or qualified health provider with any questions you may have regarding a medical condition.
4. User Accounts & Security
To access certain features of the Services, you may be required to register for an account.
- Accuracy: You agree to provide accurate, current, and complete information during the registration process.
- Security: You are responsible for safeguarding your password. You agree not to disclose your password to any third party and to take sole responsibility for any activities or actions under your account.
- Eligibility: You must be at least 13 years old to use the Services.
5. Acceptable Use Policy
You agree not to do any of the following while using the Services:
- Reverse Engineering: Attempt to decompile, disassemble, or reverse engineer any of the software used to provide the Services.
- Scraping: Access, tamper with, or use non-public areas of the Services, or scrape data using automated means (bots, spiders) without our express permission.
- Abuse: Use the Services to harass, abuse, or harm another person or entity.
- Interference: Interfere with, or attempt to interfere with, the access of any user, host, or network (e.g., sending a virus, overloading, flooding, spamming, or mail-bombing the Services).
6. Intellectual Property
The Services and their original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Nov Pax and its licensors. The Services are protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Nov Pax.
7. Termination
We may terminate or suspend your account and bar access to the Services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
8. Limitation of Liability
In no event shall Nov Pax, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- (i) your access to or use of or inability to access or use the Services;
- (ii) any conduct or content of any third party on the Services;
- (iii) any content obtained from the Services; and
- (iv) unauthorized access, use, or alteration of your transmissions or content.
To the maximum extent permitted by applicable law, Nov Pax's total liability to you for any damages shall not exceed the amount you paid the Company in the past six months, or one hundred U.S. dollars ($100), whichever is greater.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
10. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
